ROCHESTER, N.Y. — A Rochester insurance broker has been sentenced to probation after being convicted of knowingly receiving a kickback under a federal health care program.

John Weinmann was sentenced to serve three years probation and ordered to pay a $2,000 fine. In 2017, Weinmann entered an agreement with a company in Syracuse to target Low Income Subsidy (LIS) beneficiaries.

    Under the terms of the agreement, prosecutors say the company agreed to pay Weinmann for each prescription medication he was able to get filled and paid for under a beneficiary’s Medicare coverage.

    Between September 2017 and August 2018, prosecutors say Weinmann recommended and arranged for the purchase of prescription medications that weren’t needed.

    As a result, Weinmann got over $32,100 in kickbacks, according to prosecutors.
