ONEIDA COUNTY — A new inmate death investigation is underway at Marcy Correctional Facility, this time coming after a fight between inmates.
Troopers responded to the prison last Saturday after a correction officer found inmate Terry DeMonstoy, 45, unconscious in a bathroom. First responders brought him to Wynn Hospital, where he was treated in the ICU.
DeMonstoy was pronounced dead this past Monday, may 18.
New York State Police and the state Attorney General’s Office are investigating.
Troopers say in an online statement, “The New York State Police are assisting the Office of the Attorney General with the investigation. Pursuant to New York State Executive Law Section 70-b, the Attorney General’s Office has jurisdiction in matters involving the death of a person while in custody, or in cases where there is a question as to whether the death was caused by the act or omission of a police officer or peace officer.”
Marcy Correctional is the same prison where prison guards beat Robert Brooks to death, an inmate from Greece. Eight guards were convicted or pleaded guilty, and two were acquitted.
