Wayne County school districts awarded nearly $1 million in default judgments against company that failed to pay teacher dental bills

FAIRPORT, N.Y. — A court has officially awarded more than $900,000 to two Wayne County school districts in a case involving missing money from health accounts.

Schools owed $725K and $195K

Sodus Central School District was awarded $725,130 and North Rose-Wolcott Central School District was awarded $195,612 in default judgments against Health Economics Partners (HEP) and its owner Zacchary Weber. The company was hired to pay teacher dental bills but the money went missing.

    News10NBC Chief Investigative Reporter Berkeley Brean found an eviction notice at the company’s former office in Fairport. The owner was served with the court orders.

    There is also a judgment on behalf of the agency that staffed HEP.

    “Your company is owed more than $22,000,” Brean said.

    “Correct,” said Brian Harding, president of TES Staffing.

    Harding’s company staffed Health Economics Partners last year. He said his employees never got paid and the promised checks never arrived.

    “Or we did get a check at one point and we cashed it and it bounced,” Harding said.

    Default judgments are like verdicts

    The court signed default judgments for both school districts this month against Health Economics Partners and Weber. Court records show Weber was served notification about the default judgments today.

    In April, we asked Jared Cook of Tully Rinckey about default judgments.

    “In a civil case, is a default judgment effectively a verdict?” Brean asked.

    “Yes. Short answer is yes it is,” said Cook.

    Brean started reporting on the case when the lawsuits were filed last fall. Since then, Weber never replied to phone calls, emails or answered his office door. Brean went to Weber’s home address but got no answer and left a note with his phone number.

    “The people that suffered were our patients”

    Amber Hoertz manages Bay Ridge Dental in Webster, where many of the teachers and staff at Sodus and North Rose Wolcott went for care. The dentist was supposed to be paid by HEP to control the funds the teachers contributed to, but time after time the bills went unpaid.

    “Really the people that suffered were our patients, the teachers and the staff and the families that are associated with those staff members,” Hoertz said in April.

    Bay Ridge Dental continued to care for teachers and staff and worked out a deal to get paid directly by the schools. Some money is still owed.

    “Have you been made whole yet?” Brean asked Harding.

    “No, no,” Harding said.

    “Do you think this is gone?” Brean asked.

    “I don’t foresee recovering anything,” Harding said. “This is the worst we’ve ever had. Never over $20,000. This is by far the worst we’ve ever been hurt.”

    Court issues 9% interest penalty

    In addition to the money owed, the court said interest will accrue at 9% every year. There is about $50,000 in lawyers fees that have to be paid.

    The lawyers for the school districts said they have no comment on the default judgments.
