Three men accused of kidnapping mother and kids in Perinton plead not guilty

PERINTON, N.Y. — Three men charged with kidnapping two children and their mother from a government safe house in Perinton over the weekend appeared in court Monday, and a fourth man was arrested in New York City.

    News10NBC Chief Investigative Reporter Berkeley Brean and Adelisa Badžić were in court Monday and spoke with both the prosecution and defense.

    The prosecution’s side

    Court paperwork says the children and their mother were kidnapped from a safe house in Perinton set up and paid for by Child Protective Services and the U.S. Department of State. The paperwork says the children were going to be sent off to Yemen.

    The complaint says on Saturday afternoon, the three men, Omar Saleh, Dajour Paul and Gamil Ahmed, forced the 11-year-old children and their mother into a car, taking them away from the safe house and to a house in the city to hide them before they sent them off to Yemen.

    There was an ongoing custody case in family court. The complaint says the men knew a custody decision in family court was imminent.

    The District Attorney left city court saying no comment, so Brean asked David Stern, Omar Saleh’s lawyer, if he believed a crime did not happen.

    “I sincerely believe there was no crime involving kidnapping. And to answer your question – yes. I don’t believe there’s any crime,” Stern said.

    Saleh is in jail on $75,000 bail. In court, it was said he has access to incredible amounts of money.

    Dajour Paul, from Brooklyn, is in on $15,000 bail. Gamil Ahmed was released with a GPS bracelet and he gave up his passport. All three pleaded not guilty.

    If the others post bail, they get a GPS bracelet, surrender passports and need court permission anytime they leave home for court or work.

    The defense’s side

    Monroe County District Attorney Brian Green said CPS never filed a temporary removal notice because the mom who investigators say was also kidnapped started cooperating with the agency on a safety plan for the kids involved.

    Stern said Omar Saleh has parental authority over the kids, with the primary reason being the mom doesn’t speak English. He said he doesn’t know why the kids were removed and placed in an Airbnb in Perinton.

    “For whatever reason, we don’t understand it exactly, but CPS is determined to remove these children from this family. We don’t understand that at all. And, you know, ordinarily what happens on an emergency removal, there’s a petition that’s filed, and then it explains everything. So we’re kind of left in the dark here,” Stern said.

    Stern said one of the younger siblings, the boy, used a PlayStation 5 to send audio recordings to his older brother, Omar.

    “And on the audio recording it said, please come pick us up. It also said, bring the police,” Stern said.

    Amar Saleh, the other brother arrested in New York City Monday morning, provided those audio recordings to us over the weekend.

    Adelisa Badžić: “Why would he want the police there?”

    Stern: “My understanding, my interpretation of that would be that they were at a place that they did not want to be and they didn’t feel comfortable being at.”

    Stern said this was a rescue mission, and not a kidnapping.

    “I’m using the term rescue because it really describes I think what happened here,” said Stern.

    The Monroe County Sheriff’s Office said it is planning to give more information “in the interest of accuracy and case integrity.”
