Parents say new state legislation that aims to prevent drunk driving could’ve saved their son

ROCHESTER, N.Y. — New York lawmakers are pushing for legislation they say would prevent drunk driving by closing what they call a loophole in current laws.

News10NBC’s Declan Stablow spoke to a set of parents who say the law could have saved their son’s life. The law would keep people convicted of a DWI from avoiding installing court-ordered ignition interlock devices. They are breathalyzers installed into cars that keep the engine from starting unless you are sober.

    Henry Rivera Jr. was killed by an impaired driver just before he graduated high school. That driver had previously been in three other crashes involving drugs in New York.

    Henry Jr.’s parents are hopeful this law will help prevent more deaths like their son’s.

    “I think it’s a good law. You know, if they can get it to stick, it’d be great, you know, because it is it’s another device that we can use, you know, to prevent from people to be repeat offenders,” Rivera said.

    “It is one of these things that, you know, you know, if and if it could prevent, you know, incident from somebody farming that themselves or anybody in society. It is absolutely 100%, you know, worth, you know, that this law passes,” Rivera said.

    New York State Sen. Jeremy Cooney says right now, around 25% of people ordered to install IIDs actually do. Some people just wait out the duration of their punishment and others transfer ownership of their cars before sentencing.

    But this new law would require convicted DWI offenders to show they are actually using an IID over a period of six months to get their license reinstated. It also requires DWI offenders to have an IID installed in any car they use regularly, even if they don’t own it.

    Courts will have access to a log of the device to make sure it is being used. The law is a two-house bill, which means it has to get past the New York State Senate and Assembly before it will move on to Gov. Kathy Hochul’s desk.
