ALBANY, N.Y. — Rep. Claudia Tenney and the elections organization “Restoring Integrity and Trust in Elections” (RITE) are demanding records from the state Board of Elections after accusing the board of violating federal voting law.
Tenney alleges that instructions on New York’s voter registration form violate the Help America Vote Act (HAVA) of 2002. According to RITE, the form didn’t clearly ask applicants that they must provide a driver’s license if they have one.
RITE also says a state regulation instructed county officials to register people who didn’t give either a driver’s license or partial Social Security number on their registration form, even when the applicant didn’t affirm that they had neither.
RITE first sent a letter on this in November 2025. They say the BOE did revise its voter registration to reflect HAVA’s requirements but “the more serious issue remains unresolved,” stating the BOE “has not addressed the regulation requiring counties to register applicants who fail to provide any identifying number nor affirm that they possess neither, nor has it responded to RITE’s request for an audit quantifying how many such registrations have been accepted.”
Tenney and RITE want records related to those alleged violations by May 7, and are threatening to sue if they don’t get them by then.
