Earlier this month, the North Carolina Supreme Court overturned several years of its own precedent and essentially brought an end to the 30-year-old Leandro case, a lawsuit over whether North Carolina is meeting its constitutional obligation to provide all students with access to a “sound basic education” – and what it would need to do if it’s not meeting that obligation. Judges have repeatedly found that the state is failing to meet its obligation, but the Supreme Court’s ruling suggests that judges don’t have the power to enforce the constitution against lawmakers.
Aaron discusses the Leandro case with Marcus Gadson, a UNC law professor who specializes in state constitutional jurisdiction.
