The San Diego City Attorney’s Office has filed a lawsuit against the owner of an Oak Park independent living facility, whose tenants have allegedly been exposed to unsafe and unsanitary conditions.
The lawsuit states the property at 3133 54th Street has been providing unlicensed residential care for several years, all while city inspections have turned up a laundry list of code violations.
The facility dubbed “Friends Helping Friends” has rented out rooms without proper permits or approvals, according to the City Attorney’s Office, which also claimed first responders and police have responded to the home hundreds of times over the past decade for drug overdoses, medical emergencies, and homicides.
“For far too long, this property has endangered tenants, burdened first responders, and undermined the safety of the Oak Park community,” San Diego City Attorney Heather Ferbert said in a statement. “My office is taking action to stop these unlawful practices, hold the property owner accountable, and ensure that every San Diegan has the right to safe and habitable housing.”
The lawsuit filed Tuesday seeks civil penalties, to have the property declared a public nuisance, and an injunction requiring corrections of any and all violations and a prohibition against further illegal activities.
“Our neighborhoods should not have to endure nuisance properties that create public safety hazards for both tenants and the surrounding community,” said San Diego City Councilmember Henry L. Foster III, whose district includes Oak Park. “I thank the city attorney and her Housing Protection Unit for stepping in to hold this property owner accountable.”
