A preliminary hearing for a man suspected of shooting another man outside a downtown San Diego bar has been delayed until May 7,as his attorney is busy in a murder trial of another client.
Another attorney appeared on March 11 in the place of attorney Oscar Valencia, who represents Brian Keith Tyner Jr., 37. She explained to San Diego Superior Court Judge Theodore Weathers that Valencia was involved in another trial.
The prosecutor did not object.
Tyner waived his right to have a speedy preliminary hearing. He is accused of fatally shooting Antwan Eugene Bluthenthal, 46, in a third-floor building, located at G Street and Sixth Avenue.
Bluthenthal worked as a respiratory technician at the Veterans Administration hospital and was the father of an infant daughter.
A comedy club that is located on the third floor of the building was closed that night. Both men had earlier that same night been at the Cielo Rooftop Lounge, which is located on the fifth floor.
The motive in the homicide has not been stated in court, and a family friend of Bluthenthal said he did not know Tyner.
Tyner has pleaded not guilty. He remains in the George Bailey Detention Facility without bail.
