BATAVIA, N.Y. — The driver of a tour bus that crashed in Pembroke last August, resulting in the deaths of five people, appeared in court today. Bin Shao faced charges of manslaughter and negligent homicide.

News10NBC’s Declan Stablow reported live from the Genesee County Courthouse, revealing new information about the case.

    Shao claimed in a statement to state police that a loose water bottle caused the crash by blocking his brake pedal. He said he reached down to move the bottle and had to quickly turn right to avoid hitting cars ahead. He said that was when he lost control and the bus ended up on its side.

    In court, the judge increased Shao’s bail. Prosecutors argued that Shao was a possible flight risk due to his connections to China and the difficulty police had in locating him for arrest. They said he could have dual citizenship in China.

    Shao was reportedly in China for about six months, one to three years before the crash.

    Shao’s defense did not comment. His next court appearance is scheduled for May 11.
