ROCHESTER, N.Y. — A judge has denied a Rochester business owner’s request to be released from a federal immigration detention center in Batavia.
Omar Ramos-Jimenez, originally from Mexico, filed a legal challenge to his detention in ICE custody, arguing that his due process rights have been violated.
Immigration agents took Ramos-Jimenez into custody after he went to the Buffalo ICE Field Office on Dec. 3 for a “routine check-in appointment,” according to the petition he filed in federal court. The petition claims that Ramos-Jimenez was denied a bond hearing and an individualized hearing for domestic civil detention.
However, a judge denied the requests in Ramos-Jimenez’s petition and granted ICE’s motion to dismiss the petition. The judge ruled that he isn’t entitled to a bond hearing because he hasn’t been formally admitted to the U.S. According to the judge’s order, Ramos-Jimenez has been living in the U.S. illegally for 21 years, since September 2004. His attorney has filed a motion to appeal the ruling.
Back in December, hundreds gathered at the United Presbyterian Church in downtown Rochester, calling for ICE to release Ramos-Jimenez. News10NBC spoke with Ramos-Jimenez’s family members.
Ramos-Jimenez’s petition says that immigration agents first detained him in Rochester back in 2013, but released him on the condition that he regularly checked in with ICE in-person and by phone. The petition says Ramos-Jimenez has complied with all terms of his release.
