ALBANY, N.Y. — A federal judge has denied New York Corrections Commissioner Daniel Martuscello’s request to be dismissed as a defendant in a civil lawsuit related to the beating death of Robert Brooks. The lawsuit was filed on Brooks’ behalf.
The Albany Times Union reported that the judge said Martuscello ignored repeated warnings over multiple years about violent prison guards.
The Corrections Department declined to comment.
Brooks, a Greece man and inmate, was beaten by multiple guards in December 2024 at Marcy Correctional Facility in Oneida County. He died hours later.

Six of the 10 guards indicted in Brooks’ death are currently serving prison sentences.
