North Carolina Attorney General Jeff Jackson is one of nearly two dozen state leaders around the country asking a federal court Tuesday to compel the release of Federal Emergency Management Agency resilience funds, including more than $200 million earmarked for North Carolina projects.
“The court was clear when it ruled on this case in December,” Jackson said in a statement. “FEMA already broke the law once and lost in court. It cannot be allowed to continue evading the law. Towns and cities are waiting for the money they’re owed so they can be ready for the next storm.”
The motion comes amid a clash between Jackson’s Department of Justice and Republican state lawmakers, who have sought to strip his office of its ability to sue the federal government without authorization from the General Assembly. Jackson has pointed to roughly $1.5 billion his office has clawed back for the state amid a Trump campaign to slash federal grants, including FEMA awards, SNAP benefits, and education funds.
The petition, filed in the United States District Court of Massachusetts, was joined by 22 other Democratic-led states as well as the District of Columbia. The legal saga has stretched on for more than nine months, with Jackson calling for the release of the resilience funds in July 2025 when he visited a flooded pumping station in Hillsborough.
In April 2025, FEMA announced it would be canceling the agency’s Building Resilient Infrastructure and Communities program, aimed at safeguarding structures from severe flood and wind damage brought on by climate-related disasters. That decision ensnared dozens of already-approved projects in North Carolina to reinforce sewage and drinking water systems, among other resilience measures.
A federal judge ordered FEMA to undo the program’s cancellation in December, but stopped short of requiring the release of the funds. But Jackson and other attorneys general say the agency has flouted the court’s mandate to “promptly take all steps necessary to reverse the termination of the BRIC program,” with no funding in sight for the existing projects and no plans to award new grants.
Jackson said FEMA has not offered any explanation for the delay. FEMA did not respond to NC Newsline’s request for comment.
“These towns deserve those funds, and the rule of law says that FEMA must comply with the court order,” Jackson said in a video message to constituents. “So we’re going to take them to court. I intend to win, and I’ll keep you posted.”
