Michigan High School Athletic Association Expands NIL Opportunities For Individuals

On Tuesday, the Michigan High School Athletic Association announced that effective immediately, it is expanding personal branding activities — otherwise known as Name, Image, Likeness (NIL) — for student-athletes at MHSAA member schools. 

    Michigan became the 46th state to approve such NIL policies, according to the Business of College Sports high school NIL tracker. 

    The expanded policy allows additional options for athletes to capitalize on NIL, provided such activities are individual opportunities for individual students. 

    Examples include social media endorsements, personal appearances, photo sessions, autograph signings, modeling, advertising, merchandise, sports cards or apparel sales. 

    The expanded policy does prohibit group activities such as collectives or pay-for-play arrangements, and any PBA activities by individuals must be disclosed to the MHSAA within seven days of an opportunity or contract for disclosure and approval. 

    Individual NIL opportunities can also not be held on school property or as part of athletic events.

    Previously, the MHSAA allowed some PBA opportunities such as being able to conduct camps, clinics and private lessons. 

    “We have said from the start of this conversation that the MHSAA could be comfortable with a policy that provides individual branding opportunities for individual student-athletes, and this rule change provides those while excluding the possibility of collectives, and boosters and school people getting involved in those activities,” MHSAA Executive Director Mark Uyl said. “This is the essence of what NIL was supposed to allow in the first place, and we’re confident we’ve crafted language that allows true NIL opportunities without affecting competitive equity among our member schools.”  

    The MHSAA said that coaches and other employees at schools may not solicit, arrange, negotiate or promote PBA activities on behalf of their student-athletes. Such activity may put that school’s MHSAA membership in jeopardy, in addition to rendering that student-athlete ineligible for MHSAA athletics.

    The four states were NIL activities are still prohibited are Alabama, Hawaii, Indiana and Mississippi.
