Tuscaloosa judge who ruled in favor of Charles Bediako donated over $100,000 to Alabama Athletics

Tuscaloosa County Circuit Judge James “Jim” H. Roberts, who gave a temporary restraining order against the NCAA to Alabama basketball player Charles Bediako, is also an “Alliance” level donor to the University’s athletics program, with $100,000-250,000 in lifetime donations. Judge Roberts and his wife, Mary Turner Roberts, are jointly listed on the Crimson Tide Foundation website as active donors to the University’s athletic fundraising arm. In addition to donations, Judge Roberts is also a “frequent guest lecturer” at the University’s Law School and represented Alabama football player Jimmy Johns in a 2008 drug case before being appointed as a judge. Mary Turner Roberts is currently representing former UA basketball player Darius Miles in the capital murder case following his alleged shooting of Jamea Harris.

Ahead of a hearing on Jan. 27, Judge Roberts ruled temporarily in favor of Bediako, a former Alabama center who went undrafted after the 2022-23 college season. The ruling came less than a day after Bediako filed suit against the NCAA.

    After bouncing around the NBA G-League, Bediako sought an injunction against NCAA’s eligibility requirements for former pros and is now eligible to rejoin the Crimson Tide until next Tuesday. Head coach Nate Oates confirmed that Bediako would take the court in the matchup against Tennessee this Saturday, which would be his first collegiate game in almost three years.

    As college athletes have become more litigious about eligibility and transfer portal rules in the Name Image and Likeness era, other judges around the country have faced similar circumstances and recused themselees. Judge Michael O’Foghludha recently recused himself from a case involving quarterback Darian Mensah and Duke University, where he was a fan and season-ticket holder. Elsewhere, Judge Thomas Kleeh, a Mountaineers fan, recused himself from a case involving four West Virginia University athletes seeking an eligibility extension.

    While a binding precedent hasn’t been set for judges who are college sports fans or donors to recuse themselves, the American Bar Association calls for judges to disqualify themselves when they have “a personal bias or prejudice concerning a party or a party’s lawyer” or when their impartiality may otherwise be in question.
