Timothy Busfield’s upcoming film appearance will no longer be part of the final cut as his intense legal case continues to unfold.
Scenes featuring the 68-year-old actor in the upcoming romantic comedyYou Deserve Each Other are being removed following his recent arrest, according to a TMZ post shared on Monday, January 19. The Amazon MGM Studios project stars Penn Badgley and Meghann Fahy, with Busfield originally cast as the father of Fahy’s character. Because filming had already wrapped, the decision was made to edit his role out entirely rather than recast it.
Busfield is currently being held without bond in New Mexico after surrendering to authorities on January 13. He was charged with two counts of criminal sexual contact of a minor and one count of child abuse back on January 9. The charges stem from allegations involving 11-year-old twin boys who were child actors on the FOX series The Cleaning Lady, where Busfield served as a director.
The West Wing alum made his first court appearance on January 14, during which a New Mexico judge ruled that he would remain in custody ahead of a pretrial detention hearing scheduled for January 20. Busfield has denied the allegations, previously calling them “horrible” and “all lies.”

As part of his legal team’s effort to argue against pretrial detention, Busfield submitted a psychosexual evaluation that included personal details about his marriage to Melissa Gilbert. According to court filings also obtained by TMZ, Busfield described their relationship as stable and supportive, noting that their physical intimacy has changed with age. He also stated that he is heterosexual and expressed strong opposition to pornography, saying he has “always had a visceral response to it.”
Gilbert, 61, echoed those sentiments in a separate letter filed with the court and obtained by PEOPLE on January 17, urging that her husband’s safety be considered while he remains incarcerated.
“The reality is that Tim Busfield is my love, my rock, my partner in business and life,” she wrote, calling him “the beating heart of our wild and wonderful extended family.” She added, “Tim has the strongest moral compass of any human I have ever known,” and pointed to his reputation as a “favorite director” and “favorite teacher” among those who have worked with him.
Busfield remains in custody as legal proceedings continue.
