UTICA, N.Y. — Opening statements are set to begin Tuesday in the trial of Michael Fisher, the final prison guard charged in the deadly beating of Robert Brooks.

Fisher faced charges of second-degree manslaughter. Prosecutors said he failed to intervene in the attack on Brooks, who was murdered inside Marcy Correctional Facility over a year ago.
According to News10NBC’s affiliate in Syracuse, Fisher’s defense was granted a motion in October to be tried separately after prosecutors acknowledged his charge was less severe than his co-defendants.
Fisher is one of the four former prison guards who declined plea deals. Of the other three, one was convicted, while the other two were acquitted.

The prison guard found guilty, David Kingsley, was sentenced to 25 years to life in prison.

Brooks was serving a 12-year sentence at Marcy for assault after he was convicted of stabbing his girlfriend. Bodycam video showed several corrections officers beating Brooks in a medical exam room.
Attorneys seated a jury of seven women and five men on Monday in Fisher’s trial. The prosecution is expected to call its first witness on Tuesday.
The judge anticipated the trial would last about a week. If convicted, Fisher faces up to 15 years in prison.
