Marni Yang has spent the last 15 years behind bars, serving two life sentences for the 2007 murder of Roni Reuter and her unborn child.
Today in Waukegan, she attended a rarely granted evidentiary hearing, seeking a new trial.
Yang’s attorney, Jed Stone, has long claimed that mistakes were made during Yang’s 2011 trial that warranted Monday’s hearing before Lake County Judge Christopher Stride. However, he said that a re-interpretation of the ballistic evidence gathered from Reuter’s Deerfield apartment shows that Yang, who stands just five feet tall, is too short to have fired the first shot.
“We know that the shooter had to be at least 5-foot-9 inches tall and that a person who was five feet tall, 60 inches, could not have fired that shot to a reasonable degree of forensic certainty,” Stone said.
Stone said he also plans to present evidence about DNA and rounds of live ammunition, and a medical alert bracelet.
Originally, prosecutors had argued that Yang killed Reuter because she was her romantic rival for the affections of former Chicago Bears player Shaun Gayle.
Stone said he has also uncovered a videotaped deposition from Gale’s barber, Steven Wade, describing the morning of the murder.
“He came into the barber shop a wreck and said to his barber, ‘it’s over, I did it, she’s dead,’” Stone said. “The jury never heard that. The next jury will hear that.”
Gayle has denied any involvement in Reuter’s death. ang has maintained her innocence.
“Marni could not commit the crime,” said her father Larry Merar who today, stood by his daughter in the Lake County Courtroom. “We are pretty confident that at the end of the road, Marni is going to get her life back.”
Monday’s hearing is scheduled to continue Tuesday and Wednesday. It is unlikely that Judge Stride will make a ruling from the bench. He will likely do so in writing at a future date.
If he does decide to grant Marni Yang a new trial, the earliest it could start would be the fall of this year.
