North Carolina could lose federal funding over CDLs issued to immigrant drivers

The U.S. Department of Transportation is threatening to withhold nearly $50 million in federal funding from North Carolina if the state refuses to revoke commercial driver’s licenses the department contends were illegally issued to immigrant drivers.

    U.S. Transportation Secretary Sean P. Duffy issued a statement Thursday contending 54% of the state’s non-domiciled commercial driver’s licenses reviewed by the Federal Motor Carrier Administration  (FMCSA) were issued illegally.

    Such licenses are intended to be issued to foreign nationals who are in the United States legally. Canadians and Mexicans may drive in the U.S. with their home country’s licenses for temporary visits.

    “North Carolina’s failure to follow the rules isn’t just shameful – it’s dangerous,” Duffy said in a statement. “I’m calling on state leadership to immediately remove these dangerous drivers from our roads and clean up their system.”

    Duffy’s statement comes amid an ongoing nationwide audit of states’ truck licensing systems by the Federal Motor Carrier Safety Administration (FMCSA).

    North Carolina must fix its licensing “failures” and “immediately revoke” all illegally issued licenses, federal officials said.

    “The level of noncompliance in North Carolina is egregious,” said FMCSA Administrator Derek D. Barrs. “Under Secretary [Sean] Duffy, we will not hesitate to hold states accountable and protect the American people.”

    In a letter to Gov. Josh Stein, Barrs said the illegal licenses were discovered during an annual program review of the state CDL program initiated by his administration last August.

    Barrs said his administration found that the NC Department of Transportation, Division of Motor Vehicles issued:

    Non-domiciled CDLs that extend beyond the expiration of drivers’ lawful presence in the United States. Non-domiciled CDLs to citizens of Mexico not present in the United States under the Deferred Action for Childhood Arrivals program. Non-domiciled CDLs without providing evidence that it verified the driver’s lawful presence in the United States.

    The DMV shared this statement when asked to comment on the letter:

    “NCDMV is committed to upholding safety and integrity in our licensing processes,” the agency said. “We have been collaborating closely with our federal partners for several months to resolve these matters that are impacting many U.S. states.”

    U.S. Sen. Ted Budd, a Republican from Davie County, posted on  X that the “North Carolina DMV has been a complete disaster, from long wait times to paperwork issues, and beyond” under the previous administration.

    “I hope Governor Stein and the @NCDOT will quickly clean up this mess left to them by the previous administration and get North Carolina back into compliance as soon as possible,” Budd posted.

    To avoid losing federal funding, Duffy said the North Carolina DMV must take the following corrective actions:

    Immediately pause issuance of non-domiciled CDLs Identify all unexpired non-domiciled CDLs that fail to comply with FMCSA regulations. Revoke and reissue all noncompliant non-domiciled CDLs if they comply with the federal requirements. Conduct a comprehensive internal audit to identify all procedural and programming errors, training and quality assurance problems, insufficient policies and practices, and other issues that have resulted in the issuance of non-domiciled CDLs that did not meet federal rules.
