A company that operates a wholesale plant nursery based in Brighton has filed for Chapter 11 bankruptcy protection, reporting that it owed between $10 million and $50 million to creditors.
Edmundson Inc., doing business as Arbor Valley Nursery, and a related entity, Edmundson Land LLC, both sought Chapter 11 reorganization Friday and asked the U.S. Bankruptcy Court in Denver to combine their cases.
A case filed under chapter 11 of the U.S. Bankruptcy Code is frequently referred to as a “reorganization” bankruptcy. Usually, the debtor remains in possession of the property, has the powers and duties of a trustee, may continue to operate its business and may, with court approval, borrow new money.
On Tuesday, the nursery filed a motion asking the court to allow it to pay its employees.
According to court documents, the 47-year-old nursery and 25-year-old Edmundson Land are third-generation businesses that were formed by Roy B. Edmundson, the grandfather of the nursery’s present CEO and majority shareholder, Mathew Edmundson.
Arbor Valley, which has 19 employees now and many more during spring and summer months, sells landscaping supplies and services primarily to landscaping professionals.
The nursery said in the filing that it has 42,015 trees that will be harvested over the next three years and 18,000 trees ready to sell, as well as 400,000 shrubs, perennials and grasses in its present inventory. It said the projected value of those trees and shrubs, when matured and sold, is $11.6 million.
Edmundson Land owns approximately 338 acres of land that it leases to the nursery, including two tracts in Brighton, one in Eaton, one in El Paso County and a house in Broomfield. The nursery also has growing facilities in Fort Collins and Franktown.
Among the Edmundson entities’ largest creditors are Greeley-based American AgCredit FLCA and AgCredit PCA, to which they owe $22.8 million. The Greeley companies had sued the Edmundson entities and two other companies in June, and sought to have them placed into receivership.
