Three suburban teenagers are facing charges after allegedly sexually assaulting a female classmate at a high school graduation party in June, DuPage County State’s Attorney announced Tuesday.
It is alleged that the three teens each sexually assaulted the victim in a minivan in mid-June during a Saint Viator High School graduation party, the DuPage County SAO said.
Following the assault, it is alleged the victim went to a friend’s house and contacted her family. Her parents “immediately” picked the victim up and took her to a local hospital for medical attention, the DuPage County SAO said.
A judge issued an arrest warrant for three suburban 18-year-olds on December 17; Kevin Niemiec of Prospect Heights, Zachary Mascolo of Arlington Heights, and Jon Clary II of Bartlett, according to the SAO.
Mascolo was taken into custody as he was driving near his home on Dec. 21, the SAO said, and Clary and Niemiec turned themselves in to the DuPage County Jail the following day.
The SAO announced Tuesday Niemiec and Clary were each charged three counts of criminal sexual assault and Mascolo was charged with two. Criminal sexual assault is a class one felony, the SAO added.
DuPage County State’s Attorney Robert Berlin called the allegations “extremely serious,” and thanked the Roselle Police department and the DuPage County Sheriff’s Office Digital Forensic Investigation Unit for their work on the “very disturbing case.”
“A graduation party is a celebration of accomplishments and the excitement of a bright future. It is alleged that Mr. Clary, Mr. Mascolo and Mr. Niemiec violated the victim in the worst possible way and inflicted a lasting harm on a young woman,” Berlin said. “It is my sincerest hope that the victim and her family receive the care they require and deserve to help them cope with this horrific event. I commend the victim in this case for her courage and strength in bringing this matter to our attention.”
Niemiec was ordered by a judge to remain detained following his first appearance court hearing Tuesday, the SAO said. Mascolo and Clary were granted pre-trial release under the conditions that they shall not consume or possess alcohol or have contact with the victim or her family.
Niemiec is scheduled to appear in court on Jan. 12, and Mascolo and Clary on Jan. 27.
