UTICA, N.Y. — A former prison guard who pleaded guilty to manslaughter and was sentenced in the death of Robert Brooks is set to be released on bond, according to his attorney.
A New York State Supreme Court judge granted David Walters a stay of his sentence while his appeal is pending, reports our NBC affiliate in Utica. Walter’s attorney argued that his client was prosecuted on something that’s not a law, but an employment directive.
Walters posted a $100,000 bond to be released from Elmira Correctional Facility. His attorney has 120 days to file an appellate brief on the case.
The judges’ decision comes a year after Brooks’ death. Bodycam video shows several corrections officers beating Brooks, an inmate from Greece, in a medical exam room in December at Marcy Correctional Facility. He died in the hospital the next day.
In total, 10 guards were indicted in Brooks’ death. Six took plea deals, one was convicted, and two were acquitted. The last defendant, Michael Fisher, is charged with manslaughter and is set to go on trial next month. Prison reform advocates, including Brooks’ family, have been pushing Gov. Kathy Hochul to sign a bill aiming to keep inmates safe and to hold staff accountable.
