UTICA, N.Y. — Deliberations are set to resume Monday in the trial of three former prison guards charged with second-degree murder and first-degree manslaughter in the death of Robert Brooks.
Monday will mark the third full day of deliberations in the trial of David Kingsley, Nicholas Kieffer, and Matthew Galliher in Oneida County Court. They’re charged in the beating of Brooks, an inmate and Greece native, which happened in a medical exam room in December at Marcy Correctional Facility. He died in the hospital the next day.

The prosecution has told the jury that the guards acted like a gang, causing Brooks’ death. The defense has said that the guards’ presence in the vicinity or the association with others doesn’t equate to participation in a crime. It took attorneys six days to rest their case. Attorneys delivered their closing arguments last Wednesday.

During deliberations, the jury has asked for the legal definitions, including for gang assault, murder with depraved indifference, and the factors that differentiate murder and manslaughter.
In total, 10 guards were indicted in Brooks’ death, five of whom have pleaded guilty to manslaughter and one to evidence tampering. Five of them pleaded guilty to manslaughter, while one pleaded guilty to evidence tampering. The last guard, Michael Fisher, will go on trial in January on his first-degree manslaughter charge.
