A Greeley man accused of fatally shooting two people in 2022 before fleeing to California will undergo another competency evaluation after a motion was filed to declare him incompetent.
On Tuesday morning, the defense team for Paul Anthony Delgado Jr., 45, filed a motion to declare him incompetent. Later that afternoon, Delgado appeared in front of Senior Weld County District Judge Marcelo Kopcow to discuss the motion.
Delgado has undergone several competency evaluations since his September 2022 arrest, being found both competent and incompetent multiple times. In the most recent evaluation, which was completed in February, Delgado was found competent.
The motion for a new evaluation was sealed, so only Kopcow and the defense could read it. Kopcow said it included a statement of good faith that the new evaluation is not being requested just to delay proceedings. The prosecution argued that another evaluation wasn’t needed, saying Kopcow should rely on the two times Delgado had already been ruled competent.
Kopcow decided the information in the sealed motion was significant enough to justify another evaluation.
“By law, I am required to suspend the proceedings and order another competency evaluation, unless I believe there is insufficient information that there is not a good faith basis for the motion being filed,” Kopcow said. “While I can’t publicly discuss the grounds in the motion, it is my judgment that there is new information that requires the court to order a competency evaluation.”
Delgado’s case dates back to March 28, 2022, when Greeley police responded to a report of a man down after several gunshots were fired in the 1400 block of an alley between 8th and 9th streets.
When officers arrived on scene, they found Raul Calihua-Calihua, 17, lying in the alley with a gunshot wound to the head, according to an affidavit for Delgado’s arrest. He died a few days later in the hospital.
In the driver’s seat of a car parked nearby, officers found a second shooting victim, identified as 46-year-old Corry Lieby. He was pronounced dead at the scene.
Delgado faces two counts of first-degree murder after deliberation, one for each of the victims, according to Colorado court records.
Detectives found probable cause to arrest Delgado for the murders, police said, but Delgado fled to California before he could be apprehended.
In late September 2022, Los Angeles police and the U.S. Marshals Apprehension Task Force took Delgado into custody after receiving a tip about his whereabouts.
He has been held since at the Weld County Jail on a $1 million bond. He is next set to appear in Weld District Court for a review on Nov. 13.
