MARCY, N.Y. — Testimony is set to continue on Wednesday in the trial of three former prison guards charged in the beating death of Robert Brooks at Marcy Correctional Facility.
Former corrections officers David Kingsley, Nicholas Kieffer, and Matthew Galliher are charged with second-degree murder. They’re among the 10 prison staff members indicted in Brooks’ death, five of whom have pleaded guilty to manslaughter and one to evidence tampering.
Bodycam footage shows guards beating Brooks, an inmate and Greece native, in a medical exam room in December. He died in the hospital the next day.
During Tuesday’s opening statements in Oneida County Court, prosecutor William Fitzpatrick said the three prison guards had a duty to intervene to stop the beating.
“They were no longer corrections officers. They were a gang. You’re not supposed to help and stand by while others beat an inmate to death. It really ain’t that complicated,” Fitzpatrick said.
Defense attorneys blamed supervisors who were there the night Brooks was killed, referencing the chain of command.
The trial is expected to last two to three weeks. If convicted, the former guards face 25 years to life in prison. Since Brooks’ death, his family has been pushing for changes in the prison system.
