A 49-year-old man is dead after riding in a truck the driver crashed while allegedly drunk last week in Fort Lupton.
The driver of the pickup, 37-year-old Ricardo Acosta Garcia, is charged with vehicular homicide due to driving under the influence, two counts of DUI with a prior DUI arrest and three traffic infractions, according to Colorado court records.
The crash killed Ramon Luna Vazquez, who was the front-seat passenger in the pickup, according to an affidavit for Acosta Garcia’s arrest.
Around 5:15 p.m. Sept. 25, police responded to U.S. 85 and Weld County Road 22 on reports of a crash with injuries, finding a gray pickup in the ditch.
Officers first found Vazquez with severe visible blunt force trauma. He was pronounced dead shortly after.
Acosta Garcia originally told officers that Vazquez had been driving, but after speaking to another passenger in the vehicle, officers learned Acosta Garcia was the driver, according to the affidavit.
The surviving passenger, who was in the back seat, said they were stopped at U.S. 85, when Acosta Garcia peeled out “to show off” and lost control as he turned onto U.S. 85, the affidavit said.
Acosta Garcia failed all three roadside maneuvers before blowing a 0.14 — 0.06 over the legal limit. He told police he drank five beers prior to the crash, and officers found an empty beer can inside the pickup, according to the affidavit.
Acosta Garcia is being held at the Weld County Jail on a $60,000 bond ahead of an advisement hearing Friday in Weld County District Court.
