ROCHESTER, N.Y. — ICE agents were present on Westminster Road Tuesday, where they say they arrested a man from Ecuador.

    ICE confirmed the arrest Wednesday and stated they left the scene on Westminster Tuesday for safety reasons. They expected the attorney on scene to bring the two other workers on the roof to their office, but they say this didn’t happen.

    Maria Garcia, program director at the Western NY Coalition of Farmworker Serving Agencies, climbed a fire escape to speak with the workers and led negotiations with ICE agents.

    Garcia also took charge of crowd control when things started to get out of hand. She said Tuesday was not her first time confronting agents.

    “What do you have? Like, I want to know. These people are entitled to due process. Where is the warrant?” Garcia said. She noted that ICE lacked the necessary judicial orders to be on the property.

    Garcia gathered the workers’ information and had them authorize her to speak on their behalf. After confirming the lack of warrants, agents left peacefully.

    I also spoke with the wife of the arrested man, who said he has a green card since 2022, which makes him a lawful permanent resident. She expressed concern for her husband, their five children, and one on the way.

    When contacting ICE, providing the name, date of birth, and alien registration numbers helps them research requests, a spokesperson said.

    During the operation, violent rioters began to gather at the location, and they attempted to prevent law enforcement from exercising their sworn duties. These dangerous rioters vandalized and slashed the tires of a border patrol vehicle. For their own safety, officers left the scene.

    The attorney never appeared at the ICE office with the two other illegal aliens as promised to law enforcement. These illegal aliens remain at large.”
