ROCHESTER, N.Y. — A small business on North Clinton Avenue is taking the City of Rochester to court.
The owners of “EZ In Grocery ” are trying to get the city’s “Closure Order,” of the store overturned. According to court documents, the city ordered the store to close after a shooting in the area that happened on June 17.
The owners say the store was closed at the time of the shooting and that the city hasn’t given the store a reasonable opportunity to reopen. They have remained closed since June 18, when the Rochester Police Department put up the Closure Order on the door and blocked off the entrance to the parking lot.
Although it is unclear what shooting it was, News10NBC previously reported about a man who was found shot and accused of illegally possessing a gun by Rochester Police on that same day.

The city has the power to shut down businesses under the city’s “Gun Violence State of Emergency,” which was initially declared in July 2022 in response to ongoing gun violence in the city, and was last extended on Aug. 8, 2025.

In a statement, the city said that instead of issuing orders for the store to close, “the city would rather the property owner step up and provide the City with a security plan, including fencing and gating the parking lot, to end the property’s long history of after-hours violence and crime.”
“The City will respond to the lawsuit in due course. But on a fundamental level, instead of issuing emergency orders for this location, the City would rather the property owner step up and provide the City with a security plan, including fencing and gating the parking lot, to end the property’s long history of after-hours violence and crime. While we litigate this suit, we continue to actively encourage the owner to work with the City to better ensure the safety of the neighborhood.”
