ROCHESTER, N.Y. – A troubled nursing home in Charlotte is the subject of another News10NBC consumer investigation. Weeds feet tall greet guests in the garden bed in front of Waterview Heights Rehabilitation and Nursing Center in Charlotte, hinting at the growing dysfunction inside. Over seven months, family members, employees and former employees have described deplorable conditions – residents lying in their own waste for hours. The latest inspection report goes further, with some residents unbathed for more than a month, legionella bacteria in the water that went unreported for months and suspicious resident deaths.

    “They’ve imposed some civil monetary penalties on the owner which I think is very warranted but second is that they’ve put in this temporary manager,” said Assemblymember Sarah Clark, (D) District 136.

    But the advocacy group Elder Justice says that’s not enough.

    MaryDel Wypych, Chair of Elder Justice Committee of Metro Justice: “We’d like them to do an investigation.”

    Wypych points to the attorney general’s investigation of Van Duyn Nursing Home in Syracuse. This week the attorney general announced her investigation and court action against the home resulted in $12 million in penalties and independent monitors for health care, finances and compliance. Wypych points out Waterview is getting Medicaid funds.

    “So we want to make sure they’re using the money like they should and if they’re not the attorney general needs to investigate and take action,” Wypych said.

    While he wouldn’t say whether the Attorney General Letitia James is investigating Waterview, a spokesman from her office says the attorney general is aware of the situation at Waterview and strongly encourages folks to file complaints with her office.

    The Department of Health released a statement to News10 NBC about the appointment of a temporary manager that reads as follows:

    “The Department works closely with the Centers for Medicare and Medicaid Services (CMS) to ensure the health, safety and wellbeing of residents at Waterview Heights and all skilled nursing facilities. CMS imposes appropriate enforcement actions based on the scope and severity of regulatory violations identified by the Department and on analysis and discussion with the Department. In this instance, based on regulatory violations identified by the Department, CMS required the facility to retain a temporary manager until the facility graduates from the Special Focus Facility Program. CMS regulations require that the temporary manager be pre-approved by the Department and meet with the Department at specific intervals. The Department remains committed to protecting Waterview Heights’ residents’ health and safety and will work continue to work in concert with CMS to leverage appropriate remedies until the facility’s performance improves to an acceptable level, and with the Temporary Manager and operator of Waterview Heights to effectuate positive changes to the quality of life for residents.”
