New attorney appointed for man accused in motel slaying of girlfriend

A man accused of killing his girlfriend in a Hotel Circle motel room got a new attorney on Friday, and his preliminary hearing was delayed until Oct. 15.

Victor A. Cruz, 20, waived his right to have a speedy hearing concerning the death of Vivian Avila, 24, who was found dead early on Jan. 17 in a hotel in the 2400 block of Hotel Circle North by San Diego police.

    Officers took Cruz into custody after talking to another man in the same motel room.

    Police said the woman had “obvious trauma-related injuries,” according to a release. She was declared dead after officers and medics went into the room. The death is believed to be the result of domestic violence.

    Cruz is also charged with inflicting corporal injuries to his girlfriend before her death.

    Additionally, he has a prior DUI conviction.

    The new attorney, Clayton Arick, requested a new preliminary hearing date since he had just been assigned the case in the San Diego Superior Court.

    Cruz remains in the George Bailey Detention Facility without bail. He has pleaded not guilty.
