Denise Richards is taking legal action to get Aaron Phypers and his family out of the home they once shared together.
According to court documents obtained by Us Weekly on Wednesday, August 20, Richards, 54, filed a declaration asking the judge to remove Phypers, 52, and his family from the house they lived in during their marriage so she can return to the property to retrieve some personal belongings she left behind following her move.
“When I moved out over two years [ago], I left many of my personal items and my late mother’s items at the house based on Aaron telling me that his family would be moving back to Canada and we would be moving back into the [home],” the docs read.
Richards’ dogs have also allegedly been at the property since May while she recovered from two surgeries. Richards claimed that Phypers agreed to that arrangement.

However, Richards alleged that she received a message from the property’s landlord last month stating that he will begin “eviction proceedings” starting Saturday, August 23, and demanded that the residence be vacated. The landlord allegedly told Richards that Phypers has not been responsive to his messages and has not been paying rent. According to Richards, she informed Phypers in January that he would be responsible for the home’s payment.
In the docs, Richards stated that she is worried about her belongings possibly getting damaged and wants to be able to retrieve the items and her animals without Phypers being present.
Richards claimed that “Aaron and his parents and brother have severely damaged” the home as it was “in a state of disarray.” She included images that showed patches of removed flooring, several boxes, articles of clothing and papers scattered around.

“There is no emergency or exigent circumstance and the court should deny [her] ex parte request,” the docs read.
He also asked if the court does consider issuing Richards’ order, he would like the “opportunity to retrieve” his own “personal belongings” from the former residence where Richards currently resides.

Phypers filed for divorce from Richards in July after seven years of marriage. He cited “irreconcilable differences” as the reason for the split. “Throughout our relationship, Aaron would frequently violently choke me, violently squeeze my head with both hands, tightly squeeze my arms, violently slap me in my face and head, aggressively slam my head into the bathroom towel rack, threaten to kill me, hold me down with his knee on my back to the point where I would have to plead with him to get off me so that he would not kill me and hack into my laptop and phone and download all of my text messages,” Richards wrote in a declaration.
Phypers denied Richards’ allegations in a statement to Us, saying, “Let me be unequivocally clear: I have never physically or emotionally abused Denise — or anyone. These accusations are completely false and deeply hurtful. Denise and I, like many couples, have faced our share of challenges, but any suggestion of abuse is categorically untrue. I have always tried to approach our marriage with love, patience, and respect. I ask for privacy as we navigate personal matters, and I hope that the public and media will refrain from spreading harmful and baseless claims.”
