ROCHESTER, N.Y. – Six women are currently being held in the Monroe County Jail on prostitution charges with no bail set. This comes after they were arrested during a two-day quality of life detail by the Rochester Police Department on Lyell Avenue last week.
“It’s very very sad,” said Melanie Blow, who runs the Rochester Regional Coalition Against Human Trafficking.
Berkeley Brean, News10NBC: “I hear this all the time – nobody goes to jail anymore. But with the exception of one woman here all of these women are still in jail with no bail. How does that happen?”
Blow: “My understand is some of them have really serious, really well known substance abuse issues. That what they’re trying to do is give them a couple of days in jail so they can make a decision about whether or not they want to enter into the Safe Court or maybe the Drug Court or Mental Health Court.”
Prostitution on Lyell Avenue is notorious but so is other crime. A police crime map of the area this year shows numerous robberies, assaults and even murders. Every prostitution charge is a misdemeanor with a 3-month jail sentence and every day the women are in jail counts against that.
Berkeley Brean: “Here’s one of the things we looked for – so they arrested these women for prostitution. Did they arrest any of the men or women who are running them on the street.”
Melanie Blow: “Uh…”
Berkeley Brean: “We looked it up and the laws in New York say pimping and pandering.”
Melanie Blow: “Yep.”
Berkeley Brean: “But there’s not a single person in the jail on those charges at all.”
Melanie Blow: “Yes, that is an ongoing problem.”
Blow says it’s complicated because the women need to be witnesses against the people pimping them.
Berkeley Brean: “Why not?”
Melanie Blow: “Because it takes a long time for them to believe they’re victims.”
The women are in jail primarily because of bench warrants, meaning they missed a court date. One of the problems is they don’t have permanent addresses so they don’t receive notices from the court. A solution being worked on in Safe Court is a P.O. box system where mail from the court could be sent for the women.
