In a redacted police report obtained by Us Weekly on Friday, August 8, Brady told authorities he was inside feeding Trigg and now 4-month-old son Teddy while watching an NBA playoff game between the New York Knicks and Boston Celtics. The police report also indicated that Trigg was outside unsupervised for more than nine minutes and was in the water for about seven of those minutes, despite Brady initially claiming the incident occurred in the span of only a few minutes. Authorities claimed that Brady’s statements “do not match” what the surveillance video showed, alleging that he was “not aware” of what Trigg was doing and “not watching him.”
Days after Trigg was pulled unconscious from the backyard pool, the Chandler, Arizona, Police Department confirmed to Us that he died on May 18. Investigators later reccomended that Brady be charged with a Class 4 felony charge of child abuse, however, the local Attorney’s Office ultimately opted against pursuing the charge.
“Surveillance video from outside the home showed how the drowning occurred and the actual timeline of events,” a statement read. “In order to convict a person of this charge, the state has to prove beyond a reasonable doubt to a unanimous jury that the person failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show.”

Brady’s attorney Flynn Carey noted that they are “grateful to law enforcement and the county attorney for conducting a thorough investigation and confirming that this was a tragic accident.”
“Brady remains in the midst of the grieving process and is thankful to be with his family as they heal together,” the statement concluded. “We appreciate the compassion and support shown during this difficult time.”
