Advocate fights for tougher semi-truck safety laws following deadly multi-vehicle crash on I-485

CHARLOTTE, N.C. (QUEEN CITY NEWS) – The National Transportation and Safety Board is now investigating after six people were killed in a multi-vehicle crash over the weekend on I-485. The North Carolina Highway Safety Patrol said two vehicles had an accident that forced them underneath a tractor-trailer on the shoulder of the highway.

Marianne Karth from Raleigh lost two of her daughters in May 2013 in a similar situation. They were headed to a big family celebration and got slowed down in a backup on I-20 in Georgia. Their car went underneath the semi-truck.

    “I slowed down, and a truck driver did not,” Karth said. He hit our car, and it spun us around, so we went backwards into the back of another tractor trailer.”

    Karth said AnnaLeah died on impact, and Mary died a few days later from her injuries.

    Devon Bornschein is the General Manager at UPTime Truck & Fleet Parking.

    “If we can do something to provide a space for those drivers to prevent something like that from happening again, you know we’re more than happy to do so,” Bornschein said.

    Semi-trucks are required federally to have underride guards on the back but not the sides.

    Bornschein said the idea is that people in the vehicle would be safe from sliding completely underneath and stopping at the engine.

    “It’s much more common for [a vehicle] to hit it on a rear-end collision, as you expect on the highway, which his why it’s there in the rear – but you don’t necessarily see them on the sides,” Bornschein said. “Is that a solution to the problem? I think it could help.”

    In Karth’s case, the underride guard failed. With a stronger support system in place, she believes her story would be much different today, and her daughters could be here.

    According to officials, the reason why the semi-truck was parked on the interstate this weekend is part of the investigation. Karth will continue to fight to test underride safety on the sides of trailers so no more families have to endure what she lost.

    “If that were installed, many crashes, many truck crashes could have different outcomes,” Karth said.

    Karth is working on legislation to have a National Roadway Safety Advocate at the U.S. Department of Transportation and is asking for community feedback no later than August 20, 2025. You can read more about it here and about her family’s story.
