CATAWBA COUNTY, N.C. (QUEEN CITY NEWS) — A Newton police officer charged with murder is now out on bond.
Lt. Carlos Uribe posted a $100,000 bond Tuesday afternoon.
In court, prosecutors laid out new details about why they say Uribe unlawfully killed a man while on duty.
Uribe stood in a jumpsuit before a judge Tuesday on a second-degree murder charge, accused of unlawfully using deadly force while on duty, killing 21-year-old Camden Childers on June 26.
Carlos Alverto Uribe. (Catawba County Sheriff's Office)That night, investigators say they were initially trying to pull over Childers on his motorcycle for speeding and reckless driving.
Police said Childers didn’t stop, and Tuesday in court, prosecutors gave new details saying police chased Childers three separate times during that one incident.
The last chase was into a neighborhood cul-de-sac on Northern Drive NW.
Prosecutors say another officer was telling Childers to put his hands up, and prosecutors say Childers clearly had his hands up, they were empty, and there was no indication that he had a weapon.
Prosecutors say Uribe kicked Childers in his abdomen, knocking him to the ground, and that’s when the police officer fired one shot at Childers’ chest.
Childers was killed.
Prosecutors say Uribe was heard on scene saying, “That’s what you get for going for an officer’s gun.”
But prosecutors say that’s not at all what happened based on body camera video.
They say Childers posed no threat to Uribe and that deadly force was not justified.
Uribe remains on administrative leave without pay with the Newton Police Department.
There’s also an internal investigation going on. The police chief won’t comment because of the legal proceedings.
But District Attorney Scott Reilly had plenty to say. The District Attorney sent the following statement:
“In my six years as District Attorney, I have reviewed approximately 15 officer-involved shootings. In each of those cases, the use of force was found to be legally justified.
I have great respect for the professionalism and restraint shown by the men and women in law enforcement throughout our district, even in the most dangerous of situations. I recognize the difficulty and gravity of the decisions officers face on a daily basis.
When the line is crossed – when excessive or unlawful force results in a loss of life – my obligation is to the law and to justice. That duty requires accountability, regardless of profession or position. Justice is about fairness, due process and equal application of the law. No one is above the law, and no one is beneath its protection.”
