Location unknown: 18th District Attorney, ICE spar over undocumented suspect

DENVER (KDVR) — The 18th Judicial District Attorney's Office says a robbery and kidnapping suspect has been taken into federal immigration custody and the agency did not produce the defendant for his court appearances.

The prosecutor's office said that Yerbis Manuel Garcia-Quintero, 46, was scheduled to appear in court on Thursday afternoon for preliminary hearings in two felony cases.

    Garcia-Quintero is facing one case with charges of second-degree kidnapping, obstruction of telephone service and criminal mischief. A judge set his bond in the case at $100,000 and the defendant posted a surety bond to make bail on Feb. 1.

    He is also facing charges of aggravated robbery, witness/victim intimidation, second-degree assault, extortion, felony menacing, false imprisonment and criminal possession of an identification document, as well as a sentence enhancement charge of violent crime. The bond in this case was set at $250,000 and Garcia-Quintero posted this second surety bond on the same day, Feb. 1.

    After he made bond in the felony cases, the 18th Judicial District Attorney's Office said that Immigration and Customs Enforcement officers took Garcia-Quintero into custody "and sent him to a facility of state."

    "ICE did not produce the defendant for his scheduled Preliminary Hearing on Thursday and his current whereabouts are unknown to our Office," the DA's office reported.

    “Based on this turn of events, it is unlikely we’ll be able to prosecute the defendant anytime soon,” Chief Deputy District Attorney Brian Sugioka said in a release. “Sadly, the victims in these cases may not receive the justice they deserve.”

    ICE Denver addressed the matter in a quote post on X, formerly known as Twitter.

    “ICE's mission is public safety, criminal aliens will not be allowed to roam free. In the past, ICE Denver and the 18th DA have enjoyed a great working relationship, with ICE honoring writs for their trials and the 18th notifying us of detainee releases,” said ICE Field Office Director Robert Guadian in the post. “This individual was ordered removed by an immigration judge, ICE cannot keep him any longer than it takes to arrange transportation out of the country. ICE Denver hopes that the new 18th DA is willing to resolve these issues before they arise.”

    District Attorney Amy Padden said that she is committed to holding all violent offenders accountable, whether or not they are citizens or undocumented immigrants.

    “When a federal agency’s actions prevent us from performing the job I was elected to do by transporting a defendant with pending criminal charges outside of my jurisdiction and failing to produce him for a scheduled court hearing, this is a major injustice to this community and to the victims impacted by these cases," Padden said in a release.

    The DA's office said that since both criminal cases are still open, it is unable to comment further, but that "additional information will be released when appropriate."
