Man aimed gun at police drone before officer shooting: SFPD

SAN FRANCISCO (KRON) -- The San Francisco Police Department held a virtual town hall Tuesday to release details and officer body-worn camera and drone footage after the police shooting of an armed man who allegedly threatened neighbors.

The incident happened March 8 in the 1200 block of 41st Avenue near Golden Gate Park.

    SFPD said the police response began at 4:23 p.m. when a 911 caller reported that a next-door neighbor, in an adjacent backyard, was holding a firearm when he had yelled at her children playing in their backyard to "be quiet."

    The caller told police that she last saw the neighbor walking around the backyard while still holding a black firearm. When officers arrived with police drones to assist, they created a perimeter in the area and issued a shelter-in-place order for community residents.

    Police were able to reach the suspect's wife who identified him as 46-year-old Dmitri Hochstatter. Hochstatter's wife told police that he was "alone in the residence, was drinking, was depressed and owned four firearms," said SFPD Acting Commander Mark Im.

    Police said officers tried to make contact with Hochstatter while officers positioned themselves on the deck of the 911 caller's home to get a better vantage point. During this time, Hochstatter walked into his home then reappeared in the backyard — before positioning himself against a fence then "waving the firearm up in the air."

    "Mr. Hochstatter appeared to focus on the police drone above his backyard by pointing the firearm directly at it," said SFPD Acting Commander Mark Im.

    Moments later, an officer discharged their firearm, and Hochstatter was stuck by gunfire. The striking officer then broadcast on the police radio that "He just shot towards the air. Looks like he just shot himself in the arm," said San Francisco PD.

    Hochstatter collapsed to the ground and was taken into custody by rushing officers. Police said they rendered aid to Hochstatter before paramedics responded. He was taken to a nearby hospital for non-life-threatening injuries. It is not yet known what charges Hochstatter faces.

    Police said its Forensics Services Division collected evidence from the scene including "five .223 fired cartridge casings from the officer's firearm."

    Police said they recovered the following firearms belonging to Hochstatter: a Smith & Wesson M&P 9-millimeter handgun, that was loaded with a seven-round capacity magazine containing four cartridges, a Smith & Wesson 22LR rifle, a KelTec KS7 12-gauge shotgun, and a Taurus 856 38 caliber revolver.

    Police said the officer who discharged their firearm completed all training required for field tactics officers.

    SFPD said the incident is being investigated by its Investigative Services Detail (ISD), its Internal Affairs Division (IAD), and the Department of Police Accountability (DPA), and the San Francisco District Attorney’s Office.
