Westminster Councilmember Amy Phan West pleaded not guilty Monday morning, Feb. 24, to a misdemeanor charge of bribing a public officer.
Prosecutors are alleging Phan West tried to persuade a city parking control officer to not tow her husband’s Jeep in April 2023.
Phan West did not appear at her arraignment Monday morning at the Orange County Superior Court West Justice Center in Westminster. Neither did her retained attorney, Randy Collins.
Rather, another attorney in “limited appearance” represented Phan in court in front of Judge Anthony J. Ferrentino and across from prosecutor Matthew Bradbury.
The Orange County District Attorney’s office said in a January press release announcing the charge that Phan West tried to bribe the officer in 2023 by referencing her friendship with the police chief and telling the officer she was a councilmember advocating for raises for Police Department personnel.
She is not accused of explicitly offering money to the officer, OCDA spokesperson Kimberly Edds said in January. Edds said the DA’s Office learned about the event from the Westminster Police Department.
The DA’s Office is alleging Phan West was running a car rental business in the area connected through the car-sharing app Turo.
Over the course of 2023, the Westminster PD had responded to more than 20 calls for service for “dirty, unregistered or abandoned vehicles” near that intersection, the DA’s Office said.
All of those calls were related to vehicles associated with Phan West, her husband or her Turo business, Edds said.
Phan West also is facing a separate lawsuit by the city of Westminster in which the city accuses her and Councilmember NamQuan Nguyen of a misdemeanor for disrupting meetings and impairing government business.
Regarding that suit, a case management hearing in front of OC Superior Court Judge Gassia Apkarian is scheduled for May 6.
