The Supreme Court announced Friday it will hear the government’s appeal of a decision invalidating a federal subsidy program that provides affordable telecommunications services to rural and low-income consumers. The Justice Department petitioned the high court to take up the case after a lower panel ruled unconstitutional the funding mechanism for the program, called the Universal Service Fund (USF), which spends about $9 billion per year. The case enables the Supreme Court to address the scope of the nondelegation doctrine, which bars Congress from delegating its lawmaking powers to the executive branch.
