ROCHESTER, N.Y. — Timothy Green was found dead inside his apartment on Saint Paul Street in Rochester in February, and police say his biological mother and her boyfriend starved him to death.

News10NBC Chief Investigative Reporter Berkeley Brean spoke with Timothy’s stepmother, Marbrey Green, and stepsister, Latisha Marshall, who’re in Alabama, where he was raised. They said they tried to stop Timothy from moving to Rochester three years ago because they knew his biological mother had lost custody of him when he was a child. However, Timothy was 30 years old at the time and could make his own decision.

Loved ones react

Timothy was found bruised, naked and emaciated inside an apartment on the fifth floor. Berkeley reached Marbrey at her home in Alabama.

“He was very endearing,” Marbrey said. “I had him since he was three years old.”

Marbrey said Timothy had developmental disabilities and came to Rochester after his father died. She said Timothy’s biological mother, Andrea Livers, came to get him.

“We didn’t want him to go up there with her,” Marbrey said.

Marshall then described what happened. “She came down here and took him back up there. She came and got him,” Marshall said.

When Berkeley asked if they tried to stop that from happening, Marbrey and Marshall both said, “Yes.”

Marbrey said police were called and Timothy left with his mother. Police found his body inside his apartment in February. They found handcuffs and bruises on his wrists and ankles but did not find any bedding or clothes. Police said Timothy was 33 years old and weighed 88 pounds.

Charges and police reaction

“How Timothy died is beyond disturbing, disgusting and unfathomable any normal person,” Capt. Frank Umbrino of the Rochester Police Department’s Major Crimes Unit said.

Police charged Livers and her boyfriend, Lancysa Harris, with murder, kidnapping and endangering the welfare of a person with disabilities. They watched internal apartment security video of the last 45 days of Timothy’s life.

“Timothy was never seen entering or leaving the apartment at any point during that time period,” Umbrino said. “The only people coming and going were his mother and his step-father.”

Police said they have a cellphone with images of Timothy being restrained inside the apartment. Officially, police said the abuse occurred between Jan. 19 and Feb. 17, but it could be longer. The security video they watched only goes back 45 days from the day he was found.

Although Timothy’s body was found in February, it took the medical examiner until July to rule this a homicide from severe dehydration while being restrained.
