Legion Road and Chapel Hill’s Complete Community Contradiction

Madame Mayor and Town Council Members:
In the proposed redraft of LUMO presented by the staff, the definitions section has been altered in a way to remove the existing limit of four unrelated persons residing in a dwelling unit (“4 person cap”), thereby removing entirely any cap on occupancy in any part of LUMO. The implications of this change would be immediate and far reaching for residential neighborhoods attractive for and dealing with existing and increasing investor owned student housing. If implemented, this change could lead to a doubling of the student population in existing student properties within 6-12 months. Market prices for properties suitable for multiple students would double as a result of an increase in potential rental income, making them un affordable to single families. The damage to the fabric and quality of life in these single family neighborhoods would be irreversible in a matter of a few years.
As no information produced by the staff addresses this major policy change, we ask you, the policy makers, to answer a few straightforward questions. These questions are not “technical” in any way. We are seeking answers from the policy makers, not the staff charged with implementing them. The Mayor made clear in her email to me of 6/18/26 that ,“Council provides policy direction, and staff carry out that direction.” No staff member would have included a modification to our LUMO with such immediate and far reaching implications without specific policy direction from the Town Council (TC) to so. The TC would not have formulated this policy without having considered the information necessary to justify it.
We are seeking direct responses to following questions from the folks who formulated this policy change as well as the facts and information they considered
1- What were the problems with the existing limit of four unrelated persons residing in a dwelling unit (“4 person cap”) that warranted their proposed modification?
2- How would the proposed 8 person cap solve those problems.
3- What evidence is there to support these positions?
4- Which entity originated the plan removing the 4 person cap in the the new version of LUMO (“new draft”).
5- What analysis was undertaken to establish the potential negative effects of the change on neighborhood quality of life and which neighborhoods were likely to be affected? Please provide a link to it.
6- Why is the 4 person cap considered important to the preservation of the character of the Northside community but not in other similar neighborhoods a few blocks away?
