HENRIETTA, N.Y. — The man shot and killed by a sheriff deputy inside a room at the Super 8 hotel on Lehigh Station Road in Henrietta was “profoundly deaf.”That is one of the allegations in a claim filed today by the family of Gregory Allen Kase.

The claim, filed in Monroe County Clerk’s Office, names Monroe County, Sheriff Todd Baxter and the two deputies dispatched to the hotel after Kase’s wife called 911.
The claim says Kase was suicidal and in a mental health crisis. He was naked in the bathtub of the hotel room. It says he texted his wife that he cut his wrists.It says two deputies yelled at Kase from the hallway and outside the closed door of the hotel room to drop the knife. It says the deputies kicked in the door of the hotel room with their guns drawn. It says Kase “was standing naked on a slippery wet tile bathroom floor.” One of the deputies “shouted commands to drop the knife several times.”
Sometime after that, the claim says Kase was shot twice. His lawyer, Elliot Shields, says Kase was hit in the chest and stomach. He died in the hotel room.
The time between when the deputies were sent to the hotel and the shooting was 13 minutes.
The claim says Kase’s wife called 911 and reported that “her husband was suicidal, that he had sent her a message stating that he had cut his wrist, that he was mentally ill and in a mental-health crisis, and, expressly, that he was deaf.”
The claim does not say whether or not the information about Kase’s hearing impairment was relayed to the deputies. It says Kase was “totally deaf in one ear and partially deaf in the other.”It says he wore a hearing aid but could only understand speech “if he was facing the speaker and able to read the speaker’s lips.”
The day of the shooting, the sheriff’s office says Kase was shot after he did not obey the deputies command to drop the box cutter.
