A Venezuelan composer claims in a new lawsuit that he’s owed more than $300,000 in royalties from two Willie Colón songs he penned for the late salsa legend.
The legal complaint, filed by singer-songwriter Amílcar Boscán on Monday (July 20) and first obtained and reported by Billboard, focuses on the Colón songs “Caer en Gracia” and “Talento de Televisión.” Boscán wrote both these tracks for Tras La Tormenta, Colón’s 1995 collaborative album with Rubén Blades that hit No. 3 on Billboard‘s Top Tropical Albums chart.

Boscán is suing the Willie Colón Music Company, which according to the lawsuit was owned and controlled by Colón until his death earlier this year. Boscán alleges he signed over his Tras La Tormenta copyrights to this company in 1994 and was promised 50% of all publishing royalties.
“However, defendant never paid plaintiff the vast majority of the royalties owed under the songwriter agreement, and defendant never sent plaintiff the royalty statements as required by the songwriter agreement,” reads the lawsuit.
Boscán believes he’s owed more than $300,000 in royalties for the two songs, noting in the lawsuit that “Talento de Televisión” has more than 450 million streams to date on Spotify alone. He claims that Willie Colón Music Company left his name off BMI registration paperwork, “falsely representing Colón to be the composer of ‘Talento de Televisión.’”
In technical terms, Boscán is leveling claims for breach of contract and violations of the Digital Millennium Copyright Act. The composer is also asking a judge to declare that his rights to both “Caer en Gracia” and “Talento de Televisión” will soon revert back to him under copyright law’s termination right. The termination right allows an author to claw back copyrights decades after signing them away. Boscán says he sent a notice of termination to Willie Colón Music Company two years ago with an effective date of 2031, but that the publisher “has disputed the validity” of the notice and “has further disputed whether termination of the songwriter agreement would ever be permitted.”
A rep for Colón’s estate did not immediately return a request for comment on the lawsuit on Tuesday (July 21).
Colón, the Bronx-born trombonist and bandleader who’s known as one of the architects of salsa, died in February at the age of 75. He recorded a number of songs throughout the years that were composed by Boscán, who got his start as lead singer of the Venezuelan band Guaco and has also had a solo singing career of his own.
