A Chicago woman who was injured in a crash involving a Chicago police squad vehicle is challenging the findings of the police investigation after her attorney said surveillance video raises questions about how the collision occurred.
Ashley Stewart Holmes said she was driving to work on the morning of July 9 when a Chicago police SUV collided with her Buick Envista at the intersection of Madison Street and Kilpatrick Avenue on Chicago’s West Side. Holmes said she was injured in the crash and taken to the hospital.
“My head is all messed up. I got a little, I don’t know, anxiety from it,” Holmes said.
According to Holmes’ attorney Derek Martin, private security video of the crash appears to show the police vehicle’s emergency lights being activated only after the collision.
“The squad car had just stopped skidding when those lights flipped on,” Martin said. “They were certainly not on when the squad car ran through that intersection and blew that stop sign.”
Martin alleges his client was wrongly blamed for the crash and was issued three citations: failure to reduce speed, running a stop sign and having tinted windows. The surveillance video does not show the opposite side of the intersection, so it does not show whether Holmes stopped at the stop sign referenced in one of the citations.
Holmes said her vehicle was totaled and that officers later came to the hospital to issue the citations while she was being treated.
“I can’t lie. I was very upset. I even told the officer, ‘I don’t understand how you giving me tickets,'” Holmes said.
Chicago police released a narrative describing the officers’ account of the crash, acknowledging the collision, stating Holmes’ vehicle struck parked cars and noting the officers sustained minor injuries and were transported to a hospital. The department also confirmed the three citations issued to Holmes.
NBC 5 asked Chicago police to respond to the attorney’s claims about what the surveillance video appears to show and whether the department wished to comment further. As of publication, the department had not responded.
Martin also contends his client did not hear a siren before the collision. Because the surveillance video does not contain audio, NBC 5 has not independently verified whether a siren was activated before the crash.
“I don’t believe there were any sirens on ahead of time. There were certainly no lights,” Martin said.
Holmes said the crash happened so quickly she never saw the police SUV coming.
“I didn’t see that coming at all. It’s a stop sign. You would think that they’re going to stop at the stop sign,” she said.
Holmes is scheduled to appear in court on Aug. 17 to contest the citations. Her attorney also said they are evaluating a potential personal injury claim related to the crash.
