Under provisions of Senate Bill 2909, evaluators will be prohibited from using AI to assign a “numerical score or other qualitative rating for any component of a teacher’s evaluation,” according to the text of the bill.
Further, teachers will be prohibited from using AI to generate their portion of the evaluations.
The bill, which passed both chambers of the Illinois General Assembly unanimously, was signed into law by Illinois Gov. JB Pritzker on Friday, and will officially go into effect on January 1, 2027.
“I believe that our teachers should be judged based on actual observations and professional judgement, not by AI software,” Illinois State Sen. Christopher Belt, who sponsored the legislation, said in a statement. “Our educators deserve a transparent and fair evaluation process that demonstrates their actual work in the classroom and protects their privacy.”
Illinois lawmakers passed a series of artificial intelligence bills during the spring session, including the Artificial Intelligence Safety Measures Act, which puts a framework in place for AI companies like OpenAI and Anthropic to publicly disclose safety practices and to report safety incidents.
Illinois will also become the first state in the country to require third-party audits of AI systems, according to the legislation.
