A federal jury has convicted a former nurse practitioner who worked at a Carthage pain clinic of illegally distributing controlled substances, according to the U.S. Department of Justice.
Heather Marks, 43, of Murfreesboro, was found guilty Monday in the U.S. District Court for the Middle District of Tennessee on one count of conspiracy to illegally distribute controlled substances and eight counts of illegal distribution of controlled substances.
According to evidence presented during the trial, Marks was an Advanced Registered Nurse Practitioner licensed by the Drug Enforcement Administration (DEA) to prescribe controlled substances. She worked at Lifeforce Pain and Wellness, a pain management clinic formerly located in Carthage.
Federal prosecutors said that from September 2016 through May 2018, Marks and others at the clinic overprescribed highly addictive opioid medications, including oxycodone and oxymorphone, to patients seeking treatment for pain.
Evidence presented at trial showed that Marks prescribed nearly one million opioid pills to approximately 1,000 patients during the conspiracy. Prosecutors alleged that many of those patients were addicted to illegal drugs and the opioids prescribed through the clinic.
According to the Department of Justice, Marks ignored signs that some patients were using illegal drugs while receiving opioid prescriptions and continued prescribing medications despite concerns that the drugs could be abused or sold illegally. Prosecutors also argued that she prescribed opioids to patients she knew were likely diverting the medications for street sales.
Court records indicate that patients often traveled hundreds of miles to obtain prescriptions from the Carthage clinic because they believed they could receive opioid medications there.
Marks is scheduled to be sentenced on September 1, 2026. She faces a maximum sentence of 20 years in federal prison on each count of conviction. The final sentence will be determined by a federal judge after consideration of federal sentencing guidelines and other statutory factors.
The case was investigated by the Federal Bureau of Investigation, the U.S. Department of Health and Human Services Office of Inspector General, and the Tennessee Bureau of Investigation.
The prosecution was handled by Assistant Chief Jim Hayes and Trial Attorneys Lauren Randell and Manu Sebastian of the U.S. Department of Justice’s Criminal Division Fraud Section.
