The Court of Cassation on Monday began hearing the appeal filed by an 81-year-old financial controller at a private school against his 10-year prison sentence issued by the Damanhour Criminal Court of Appeals.

He was convicted of sexually assaulting a seven-year-old boy named Yassin in Beheira Governorate.

The Court of Cassation’s prosecution office, in an advisory capacity, recommended rejecting the appeal of the defendant, identified as “S.K.,” and upholding the original sentence.

Yassin’s mother confirmed her intention to attend Monday’s hearing, expressing her confidence in the Egyptian judiciary, saying, “We trust in the justice system, and we hope to restore Yassin’s rights.”

The family’s lawyer explained that the legal team is not only seeking the upholding of the current sentence but also intends to submit a formal request to the Court of Cassation to exercise its legal authority as stipulated in the Code of Criminal Procedure.

The lawyer indicated that this procedure aims to compel the court to address other facts or individuals whose involvement in committing or covering up the crime within the school, and who may have been revealed in the case file, but were not included in previous investigations.

The lawyer pointed to fundamental questions regarding how some school officials handled the incident and the extent of their knowledge of its details.

He added that current legal indicators and facts suggest the previous ruling will be upheld, unless new developments arise during the proceedings that alter the course of the case.

The case dates back to January of last year, when the child’s mother discovered injuries on her son.

Medical examinations and a subsequent forensic report confirmed that these injuries resulted from recurring molestation the child suffered in the school bathroom during the school day.

The Damanhour Criminal Court of Appeals had previously reduced the defendant’s sentence from life imprisonment to 10 years in prison, taking into account his health condition and age.

In its reasoning, the court emphasized its complete confidence in the defendant’s guilt, based on corroborating oral and forensic evidence, the credibility of witness testimonies, and the victim’s ability to accurately identify the defendant during the legal identification procedure.
