MONROE COUNTY, N.Y. — Wayne Plummer is accused of posing as a driving instructor and raping an 18-year-old at his apartment.
News10NBC’s Erin Mahon looked into the case and found Plummer remains in custody at Monroe County Jail, as of 3 p.m. on Tuesday. However, he can post bail at any time.
Police say the 18-year-old got in Plummer’s car on Saturday after he pretended to be her driving instructor. From there, they say he took her to his apartment across town and raped her.

The following day, Judge Michael Lopez set his bail at $5,000. But the District Attorney’s Office says it requested bail be set at $100,000.
Police confirmed Plummer does not have any prior convictions. But Mahon found $5,000 sounded low, especially compared to what prosecutors asked for.
Looking at the state’s pre-trial release data by year, Mahon filtered through the two most recent years. She narrowed the list down to Monroe County, rape cases and if bail was set.
For 2025, there’s only one instance where bail is set at $5,000. For 2024, the lowest is $2,500 and then $5,000.
Aside from these outliers, every other rape case sets bail between $15,000 and $100,000. And looking at the column for what prosecutors requested, it ranges from $20,000 to $200,000.
The District Attorney’s Office says it can’t comment on prior history, nor is it able to see why those outliers might have small bail amounts set.
Mahon went to the Public Defender’s Office and the court to try and find out why Plummer’s bail was low. She has not heard back from the Public Defender’s Office.
Judge Lopez’s court clerk said he did not have a comment. She gave Mahon a number to call and leave a message, but after multiple attempts and no way to leave a voicemail, Mahon has not gotten through.
Plummer’s due back in court Friday for a preliminary hearing. Police also confirmed he’s a crossing guard for the city, but they’re working to end his employment.
