Bills to rein in artificial intelligence will be among the topics tackled by the Colorado legislature this week.

On Wednesday, the House Health and Human Services Committee is set to debate a pair of bills focused on AI use in health care.

The first, House Bill 1195, seeks to prevent psychologists, counselors, social workers, marriage and family therapists and others from using AI to provide therapy to clients via direct interactions, to make treatment plans or to detect emotional or mental states.

The second, House Bill 1139, would limit how health insurance companies, pharmacy benefit managers, behavioral health administrators and others in the field can use AI when determining coverage.

As written, the bill would require AI models to consider the patient’s individual circumstances when making care decisions. AI would also be allowed to help with expedited approvals, but the bill would require recommended denials or delays to be reviewed by a licensed clinician or physician.

“We must do our part to ensure that we do not create a two-tiered health care system, one where wealthy people get human-centered care and the rest of us get AI-generated care,” Rep. Junie Joseph, a Boulder Democrat sponsoring HB 1139, said.

On Monday, the House is expected to hold its formal vote on a proposal to ban 3D-printed guns. The measure will still need to go through the Senate before going to Gov. Jared Polis.

Later that afternoon, the House State, Civic, Military and Veterans Affairs Committee will also hear a series of gun bills. House Bill 1265 would require Colorado law enforcement agencies to register with federal and state databases each firearm they recover or confiscate.

The committee will also hear House Bill 1126 and Senate Bill 4. HB 1126 would expand gun dealer licensing requirements to include employees of registered gun dealers. SB 4 would expand who can file extreme risk protection order requests to include more health care and mental health care professionals and allow institutions to file the requests. That bill has already passed the Senate and now needs House approval before going to Gov. Jared Polis.

On Tuesday, the full House will consider House Bill 1005, which would lower the threshold for unions negotiating their first contract. That bill is similar to a measure Polis vetoed last year, and there’s been no indication a compromise has been reached.

Later that day, the House Judiciary Committee is set to hear House Bill 1012, which would crack down on so-called captive consumer prices. That bill is aimed at high prices in places where customers don’t have options to shop around, such as sporting arenas and hospitals.

On Thursday, the Senate State, Veterans and Military Affairs Committee will consider a change to the Colorado Open Records Act. If Senate Bill 107 becomes law, it would extend CORA response times from three days to five and extensions from seven days to 10; allow public agencies to charge more if requests are determined to be made for business purposes; and delay responses if the records custodian is not scheduled to work.
