ROCHESTER, N.Y. — New Yorkers with pistol permits have the right to carry concealed weapons in public, but there are important restrictions to be aware of, especially in sensitive locations.
Matt Winchell, an associate attorney at Tully Rinckey PLLC., explained that while permit holders can carry in public, they cannot do so in areas deemed sensitive, such as malls, schools, and places with a large police presence.
More sensitive areas can be found on the state’s website under the “Restrictions on Carrying Firearms in Certain Locations” tab.
He noted that bringing a firearm to a peaceful protest is legal, but not always advisable.
“There’s some carve-outs where you can’t carry it, and they’ve added to those carve-outs in the recent three or four years. But generally speaking, if you’re out in the public, you can carry within New York State.” Winchell said.
“So, with regard to the Alex Pretti situation, maybe it wasn’t the smartest thing to bring a pistol to the protest, but the law is adequately clear that you have the right to do so,” He added.
David Jenkins, the founder and primary instructor at Rochester Personal Defense, emphasized the importance of permit holders being proactive in de-escalating situations.
“We have to be the first one to deescalate, the first one to want to walk away to avoid the problem in the beginning, because that is more valuable than allowing a situation to get so bad that we have to defend ourselves because when it comes to that, you’re risking, potentially your freedom,” Jenkins said.
Permit holders are advised to be aware of protected zones and the responsibility that comes with carrying a concealed weapon. Violating regulations can lead to the loss of your permit.
